JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 05.12.2014 on the accusation that he made fake entry in the measurement book as a result thereof, Rs. 3,07,500/- was made as advance to the concerned agent.

The contention on behalf of the petitioner is that the concerned agent, namely, Md. Sekh Rasool @ Sheikh Rasool has already been granted provisional bail by a Bench of this Court vide order dated 29.01.2015 passed in Cr. Misc. No. 3548 of 2015 subject to condition that said agent shall deposit Rs. 3,07,500/- within a period of four weeks.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.4265 of 2015 (2) dt.12-02-2015 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 818 of 2014, subject to condition that if the bail of co-accused, Md. Sekh Rasool @ Sheikh Rasool is cancelled by the trial court due to non-deposit of the aforesaid amount, the same treatment shall be given to the petitioner also.
