JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2019 Petitioner apprehends his arrest in connection with Siwan Muffasil (Dhanauti O.P.) P.S.Case No. 525 of 2018 registered for the offences punishable under Sections 272, 273, 308 of the Indian Penal Code and Sections 30(A) and 41(i) of Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 432 litres of liquor from one vehicle and petitioner is named in the FIR and further petitioner is accused in five more cases, some of which are under Excise Act.

Submission of learned counsel for the petitioner is that petitioner has been made accused at the instance of his uncle with whom he has enmity.

Heard learned APP also.

Having heard both sides and in view of recovery of

Patna High Court Cr.Misc. No.78371 of 2018(2) dt.08-01-2019 2/2 huge quantity of liquor and also criminal antecedents of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order. With the above observation, this application is dismissed.
