The petitioner seeks bail in Balrampur P.S. Case No. 79 of 2009, registered for the offences punishable under Sections 366A, 372 of the Indian Penal Code.

The father of the victim alleged that Bhimshankar Tiwari, the petitioner kidnapped his daughter on 16.11.2009 but the FIR was lodged on 22.11.2009. The victim appeared and made her statement under Section 164 of the Cr.P.C. on 20.08.2014. She disclosed that she lived with Bhimshankar Tiwary who always assured her to convert his religion. She also thought to live with Bhimshankar Tiwari but he always used to bring girls. She got a four year son, namely Sonu.

From the perusal of the statement of the victim it

Patna High Court Cr.Misc. No.10279 of 2015 (3) dt.08-05-2015 2/2 appears that the victim was living with the petitioner as wife and she also gave birth to a child aged about four years. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Balrampur P.S.
