2. The petitioner is in custody since 01.08.2016 in connection with Economic Offence P.S. Case No. 09 of 2016 for the alleged offences under Sections 419, 420, 467, 468, 471, 120(B) of the Indian Penal Code and Section 3 of the B.P.I.D Act, 2003.

3. It is submitted that the petitioner has been falsely implicated and he had no role to play in the offence alleged against the Co-operative Society. The petitioner was merely a signatory to the agreement for giving the premises on rent and was merely working as a Computer Operator, and had no field work or any concern with the management of the

Patna High Court Cr.Misc. No.48699 of 2016 (3) dt.13-12-2016 2/2 Society and could not have indulged in financial irregularities on behalf of the Society, if any.

4. Mr. Akhileshwar Prasad Singh, appears on behalf of the Economic Offence unit, Bihar, Patna and opposes the bail application.

5. Having regard to the entirety of the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Patna, in connection with Economic Offence P.S. Case No. 09 of 2016 on the following conditions:

(i) That one of the bailors shall be a close relative of the petitioner.

(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial. (iii) That the petitioner shall remain physically present in Court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned.
