The petitioner is apprehending his arrest in connection with Pusa P.S.Case no.29 of 2018 , registered for offences punishable under Sections 363, 366, 366A, 34 of the Indian Penal Code.

Allegation is of kidnapping of the minor daughter of the informant.

Submission of the learned counsel for the petitioner is that as a matter of fact the victim girl has married with the petitioner and she has stated so in her statement under Section 164 Cr.P.C., which will appear from the impugned order itself. From the impugned order it further appears that the medical report shows the age of the victim girl as 18 years. Heard learned A.P.P. also.

No.78051 of 2018(2) dt.04-01-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM VIth, Samastipur in connection with Pusa P.S.Case no.29 of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
