The petitioner seeks bail in Kisanpur P.S. Case No.22 of 2014 registered under Section 364 of the Indian Penal Code.
The prosecution case, in brief, is that on the written report of the informant, the instant case has been registered against unknown and it is alleged, inter alia, that on 23.1.2014, the victim had gone to purchase some domestic articles at Sukhashan but did not return in the night. It is further alleged that mobile cell of the victim was found switched off. On search no clue was found. It has been submitted that the petitioner is not named in the first information report. Further it is submitted that
Patna High Court Cr.Misc. No.16249 of 2015 (2) dt.10-06-2015 the informant in his written statement made before the Investigating Officer has named the petitioner on the basis of suspicion. It is also submitted that due to enmity, the informant had tried to develop the prosecution case by naming the petitioner in the present case. It has further been submitted that other coaccused have been granted bail by this Court in Cr. Misc. Nos.14551/2015 and 3346/2015 respectively.
On behalf of the State, it is submitted that in the course of investigation the petitioner's name has appeared and he has played an active role in abducting the victim. Considering the aforesaid facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Supaul in Kisanpur P.S. Case No.22 of 2014.
