The petitioner seeks his bail in Sultanganj P.S. Case No.154 of 2011 registered under Sections 406, 379 and 34 of the Indian Penal Code.

The allegation against the petitioner is that he was apprehended along with other accused on suspicion of stealing the Sumo vehicle of the informant.

It has been submitted on behalf of the petitioner that the main allegation is against Tutu Yadav, driver of the vehicle, who is said to have allegedly taken away the vehicle only on false pretext. It is submitted that as far as the petitioner is concerned, the only allegation against him is that he was also found sitting in the vehicle along with other accused persons. Except for this, there is no other evidence with respect to the theft of the vehicle. The petitioner is in custody since 27.8.2014. On behalf of the State, it has been submitted that the name of the petitioner has come in course of the investigation.
