JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and according to prosecution case itself, petitioner and some other persons had given information to informant regarding the death of the deceased and after that informant lodged the present case having noticed some injuries on the neck of the deceased. The informant neither in her written report nor in her further statement disclosed the date of marriage but even then the police officials lodged the case under Section 304B of the Indian Penal Code. Admittedly, in the present case, no one has seen the actual killing of the deceased.

The stand of the petitioner is that deceased

Patna High Court Cr.Misc. No.47374 of 2014 (6) dt.08-09-2015 2/2 committed suicide due to some petty issue.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Bahadurganj P.S. Case No. 88 of 2014.
