Petitioner apprehend arrest in connection with Arrah (Mahila) P.S. Case No. 154 of 2013 registered for the offence punishable under section 341, 323, 379, 498A/34 of the Indian Penal Code and sections 3/4 of the Dowry Prohibition Act.

Learned counsel appearing for the petitioner submits that petitioner has not committed any offence as alleged in the first information report and he has been falsely implicated in this case. Petitioner is brother-in-law of the deceased and was living with his parents separately from the deceased and her husband.

Patna High Court CR. MISC. No.43242 of 2021(4) dt.19-04-2022 2/2 Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner is named accused in the first information report and there is direct allegation of demand of dowry and torture against him. Petitioner, therefore, does not deserve to be granted the privilege of bail.

Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected.
