Mr.Ram Sevak Choudhary, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 18-06-2025 Heard Mr. Satya Prakash Parasar, learned counsel appearing on behalf of the petitioners and Mr. Ram Sevak Choudhary, learned APP for the State.
2. The petitioners seek pre-arrest bail in connection with Sono P.S. Case No. 342/2024 registered for the offence(s) punishable under Sections 112(2), 115(2), 109(1), 352, 351(2) and 3(5) of the BNS.
3. As per the allegation made in the FIR, all the accused persons including the petitioners with a common intention had assaulted the informant and his father and brother on the vital parts of the body. Specific allegation against Sarita
Patna High Court CR. MISC. No.36707 of 2025(2) dt.18-06-2025 2/3 Devi (petitioner no.3) is to have assaulted the father of the informant by means of bricks, whereas Anuj Ram (petitioner no.4) had assaulted the informant on his forehead with sword and Mohan Ram (petitioner no.2) had assaulted the brother of the informant with sword.

Learned counsel appearing on behalf of the petitioners submitted that petitioners are innocent and they are neighbours of the informant and for trivial issue, they indulged in fierce fight in which the informant, his father and his brother had sustained injuries, which are opined by the doctor to be simple in nature. General and omnibus allegation has been levelled against Aman Kumar (petitioner no.1). Petitioners have clean antecedents.
5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.
6. Considering the nature of allegation made against the petitioners no.2 and 4, who have assaulted the informant and his brother by means of sword on the vital parts of the body, I am not inclined to grant pre-arrest bail to the petitioners no.2 and 4.
7. So far as petitioners no.1 and 3, above named, are concerned, considering the nature of allegation made

No.36707 of 2025(2) dt.18-06-2025 3/3 against them, petitioners no.1 and 3 are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Jamui in connection with Sono P.S. Case No. 342/2024, subject to the conditions as laid down under Section 482(2) of the BNSS.
8. The learned District Court is directed to verify the criminal antecedent of the petitioners no.1 and 3 and if it is found that the they are involved in some other cases, as what has been stated in paragraph no.3 of the bail application, this order will automatically lose its force.
9. The bail application stands disposed of.
