The petitioner seeks bail in a case registered under Section 393 of the Indian Penal Code and 27 of the Arms Act. The prosecution case in short is that the accused persons committed broad day robbery and in course of that, firing was made and the informant was injured by the criminals. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 22-01-2019. Charge sheet has already been submitted. There is no recovery of any incriminating article from possession of the petitioner. The petitioner is not named in the FIR. He has not been put on test identification parade. Merely on the basis of secret information,
Patna High Court CR. MISC. No.32248 of 2019(2) dt.16-05-2019 2/2 the petitioner has been made accused in this case. The source and genuineness of the secret information has not been disclosed by the prosecution.
On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Pandaul P.S.
