JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 17-02-2022 Heard the parties through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Mansahi P.S. Case No. 08 of 2021 instituted for the offences punishable under Sections 135 of the Bihar Electricity Act.

Learned counsel for the petitioner submits that there is a remedy available with regard to the settlement committee and he may be allowed to appear before the settlement committee.

Learned counsel appearing for the Electricity Department does not object and submits that the settlement committee shall decide the matter.

No.43085 of 2021(4) dt.17-02-2022 2/2 Having considered the aspects, taking into consideration the provisions of the settlement committee which provide depositing of 25% of the claimed amount as a priority before the settlement committee. If the petitioner deposits the said amount, he may approach before the settlement committee. In the circumstances the petitioner is allowed bail, in the event of arrest he shall be released on anticipatory bail, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
