JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2019 This application, for grant of anticipatory bail, arises out of Naugachia P.S. Case No. 244 of 2017, disclosing offences under Sections 341, 323, 504, 420, 379, 406, 354B and 34 of the Indian Penal Code.

Allegation against the petitioner no. 1 that he took Rs. 12,000/- from the informant in lieu of providing Indira Awas and when she was not provided Indira Awas, she along with her husband went to the house of the petitioner no. 1, where, they were assaulted by both the petitioners and the petitioners also snatched the golden chain worth Rs. 30,000/-. Submission of learned counsel for the petitioners is that out and out false and fabricated allegation has been levelled against the petitioners and no such occurrence has ever taken

Patna High Court Cr.Misc. No.78510 of 2018(2) dt.09-01-2019 2/2 place and petitioners have not taken any money from the informant. It has also been submitted that petitioners have been made accused only due to dispute with respect to election of Panchayat Sadasya.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -1, Naugachia, Bhagalpur, in connection with Naugachia P.S. Case No. 244 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
