The petitioner has renewed his prayer for bail in a case registered under sections 20(b)(ii)(c) and 22(c) of the N.D.P.S. Act.

As per the prosecution case, 48.5 kgs of ganja was recovered from the house of the petitioner and he was taken into custody.

It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 9.3.2022 passed in Cr. Misc. no.36011 of 2021. Inspite of the petitioner having remained in custody for nearly two years, there is no chance of the trial concluding in the near future as only two witnesses have been examined out of the eleven chargesheet witnesses. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the recovery of 48.5 kgs of ganja from the house of the petitioner and the petitioner being taken into custody on the spot, the Court is not inclined to enlarge the petitioner on bail and the application is rejected. Liberty is granted to the petitioner to renew his prayer for bail in case there is no substantial progress in the trial in the learned trial court in six months from the date of communication of this order to the learned trial court.
