JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 27.02.2015 in a case registered for the offences punishable under section 395 and 397 of the Indian Penal Code. On commission of dacoity in the house of informant, first information report was lodged against one Santosh Yadav and 20-25 unknown. The name of petitioner sprang up on the confessional statement of co-accused Subhan. Statement has been made in paragraphs 7 and 8 of the petition that neither any recovery has been made from the possession of the petitioner nor he been put on test identification parade.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.16824 of 2015 (3) dt.22-06-2015 2/2 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jogbani P. S. case No. 160 of 2008 corresponding to S. G. R. No. 2776 of 2008.
