The petitioner is apprehending his arrest in connection with Kudhani P.S.Case no.440 of 2018 dad 3.9.2018 , registered for offences punishable under Sections 341, 323, 406, 420, 504, 506/34 of the Indian Penal Code.

Allegation as per FIR is that the father of the petitioner sold some parts of the land to the informant and thereafter the informant purchased 04 kathas of the land on consideration money of Rs.14,00,000/- from the father of the petitioner but this petitioner objected to that and demanded Rs.25,00,000/-. Submission of the learned counsel for the petitioner is that the FIR only shows that the petitioner has demanded more money and that has not been fulfilled as such no case is made out Under Section 406 and 420 of the IPC.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM cum Sub Judge 3rd, Muzaffarpur in connection with Kudhani P.S.Case no.440 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation of the case.

With the aforesaid observation, this application is allowed.
