The petitioner has preferred the instant application for grant of regular bail in a case registered under sections 20 and 22 of the NDPS Act and sections 37(b) and (c) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on a raid being conducted on a hut a total of 500 gram of ganja was recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. The petitioner is in custody since 25.3.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the petitioner not having any criminal antecedent under the NDPS Act together with the petitioner having remained in custody for over 6 months, this Court directs the petitioner to be enlarged on bail in connection with Dighwara P.S. Case no.74 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Chapra, District Saran.
