JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the petitioners and the State. The petitioners are accused in a case under sections 302/34 of Indian Penal Code.
The allegation against the petitioners are that they caught hold of the deceased and accused Kailash Singh fired on him, as a result of which he succumbed to injuries.
Learned counsel for the petitioners submits that it is very improbable that three persons would catch hold of the deceased while other accused opened fire.
Having considered the facts and circumstances of the case, I am not inclined to grant bail to the petitioners at this stage. The prayer for bail of the petitioners is, accordingly, rejected. However, they may renew their prayer for bail after two months.
