The petitioner is apprehending his arrest in connection with Supaul P.S.Cae No.575 of 2018 GR.No.1961 of 2018 , registered for offences punishable under Sections 341, 323, 307, 427, 504 and 34 of the Indian Penal Code.
Allegation against the petitioner, who is step son of the informant is that he entered inside the hose of the informant and assaulted by handle of the tubewell.
Submission of the learned counsel for the petitioner is that no injury has been received by any of the person and the case is of family dispute.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named,
Patna High Court Cr.Misc. No.78594 of 2018(2) dt.10-01-2019 2/2 in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Supaul in connection with Supaul P.S.Case No.575 of 2018 G.R.No.1961 of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation..
With the aforesaid observation, this application is allowed.
