The petitioners seek bail in a case under Sections 302/34 of the Indian Penal Code.
The informant made allegations that the petitioners and others came in the hut and both the petitioners, namely, Mohan Rajwar and Madan Rajwar strangulated his son to death. Chhote Lal Rajwar and others sat on the chest of his son. Learned counsel for the petitioners submits that there is no motive. The petitioners have falsely been implicated in the case and they are rotting in jail since 04.12.2013 and 25.11.2013. Chhote Lal Rajwar has already been enlarged on bail vide order passed in Cr. Misc. No. 26259/2014.
It appears that there are very specific allegations
Patna High Court Cr.Misc. No.8029 of 2015 (3) dt.31-03-2015 2/2 against both the petitioners that they strangulated the minor son of the informant to death and the witnesses have also stated the same fact.
Considering the facts aforesaid, I am not inclined to enlarge the petitioners on bail in Karakat P.S. Case No. 273 of 2013. Accordingly, the same is rejected.
The trial court is directed to expedite the trial and conclude the same within nine months from the date of receipt of this order.
