Petitioner seeks bail in Complaint Case No.1465 of 2017 for the offence allegedly committed by the petitioner under Section 498A of the Indian Penal Code and under Section 4 of the Dowry Prohibition Act.
The petitioner is the husband of the complainant. Learned counsel for the petitioner submits that on the same and similar allegation, the complainant earlier lodged Rajepur P.S. Case No. 108 of 2017 in which the petitioner has already been granted anticipatory bail vide order dated
Patna High Court Cr.Misc. No.79213 of 2018(2) dt.28-01-2019 2/2 09.11.2017 passed in Cr. Misc. No. 53132 of 2017 and on the same allegation the complainant filed this complaint case in the court of Chief Judicial Magistrate, Muzaffarpur. Learned counsel for the complainant could not be able to point out as on which new facts the complaint case is filed. Considering the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., East Muzaffarpur in connection with Complaint Case No.1465 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
