====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 22-03-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Maharajganj P.S. Case No. 250 of 2020 registered under Sections 342, 323, 324, 326, 307, 338, 504, 506 and 34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that similarly situated co-accused persons have already been allowed bail by Co-ordinate Benches of this Court vide Cr. Misc. No. 10313 of 2021 and Cr. Misc. No. 17177 of 2021 on 10.06.2021 and 16.07.2021 respectively.

No.43220 of 2021(2) dt.22-03-2022 2/3 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in connection with Maharajganj P.S. Case No. 250 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C. and further:- (i) that one of the bailors shall be a close relative of the petitioner.

(ii) that the petitioner and the bailors shall execute bond and give undertaking with regard to good behaviour of the petitioner.

(iii) that the petitioner shall co-operate with the Court/police/prosecution.

Any violation of the terms and conditions of the bonds or the undertaking or non-cooperation shall lead to cancellation of his bail bonds.

It shall also be open for the prosecution to bring any violation of the foregoing conditions of bail by the petitioner, to the notice of the Court concerned, which shall take immediate

The application stands disposed off in the aforementioned terms.
