JUSTICE SHAILENDRA SINGH ORAL ORDER 06-08-2025 As both the criminal miscellaneous petitions are arising out of the same P.S. case number, hence, they are heard together and decided by a common order.
2. Heard learned counsels for the petitioners and learned APPs for the State.
3. At the outset, it is informed by Mr. Binod Kumar
Patna High Court CR. MISC. No.32770 of 2025(4) dt.06-08-2025 2/3 No.3, learned APP for the State that in the cause list, the name of the then learned APP, Mr. Dashrath Mehta, is reflecting despite his demise about three to four months back. The office is not caring this fact and his name is continuously reflecting in the cause list.
4. The office is directed to ensure the non-publication of the name of Late Mr. Dashrath Mehta in the cause list as learned APP or in other capacity in respect of all cases.
5. Petitioners seek regular bail in connection with Rosera P.S. Case No. 45 of 2025 dated 14.02.2025 registered for the offences punishable under Sections 3, 4, 5 and 7 of the Immoral Traffic Prevention Act.
6. The main submissions advanced by petitioners' counsel are that the petitioner, Sulekha Kumari, is a handicapped lady and has been languishing in jail since 15.02.2025 and against her, the investigation has been completed, though, against her, there is allegation of running a prostitution racket but she has never remained involved previously before the commission of the alleged occurrence and her past history is completely clean. It is further submitted that the petitioner, Raju Kumar, had gone to visit his maternal uncle's house which is situated in the same locality and was
Patna High Court CR. MISC. No.32770 of 2025(4) dt.06-08-2025 3/3 waiting outside the house and on mere suspicion, he has been implicated in the case and he has been languishing in jail since 15.02.2025 and against him also, the investigation has been completed.
7. Learned APPs for the State have opposed the prayer for bail of the petitioners.
8. In the facts and circumstances of this case as well as considering the aforesaid submissions and mainly the custody period of the petitioners and also, the completion of investigation against them, this Court is inclined to release both the petitioners on bail. Accordingly, let the petitioners namedabove be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Rosera P.S.
