The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 147, 149, 341, 323, 354B, 504 and 379 of the Indian Penal Code. As per the prosecution case, the petitioner is said to have assaulted the husband of the informant with the davia causing serous injury in his hand.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in the case. The manner of occurrence is other than what has been narrated in the FIR. The petitioner is in custody since 2.9.2021 and investigation in the case is complete.

Learned counsel for the informant submits that there is direct allegation against the petitioner of having caused grievous injury on the husband of the informant. Having heard learned counsel for the parties and taking into consideration the nature of allegations together with the petitioner having remained in custody for more than 1 year 4 months since 2.9.2021 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Udakishunganj P.S. Case no. 139 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1, Uda Kishunganj, Madhepura.
