JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2019 This application, for grant of anticipatory bail, arises out of Keoti P.S. Case No. 173 of 2018, disclosing offences under Sections 497, 328, 34 and 506 of the Indian Penal Code. Allegation against the petitioner is of having illicit relationship with the wife of informant.
Submission of learned counsel for the petitioner is that out and out false and fabricated case has been lodged by the informant against the petitioner. It has also been submitted that petitioner has never visited the house of the petitioner. Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on
Patna High Court Cr.Misc. No.78694 of 2018(2) dt.10-01-2019 2/2 furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -VII, Darbhanga, in connection with Keoti P.S. Case No. 173 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
