The petitioner seeks bail in Deepnagar P.S. Case No. 301 of 2020, registered for the offence punishable under Sections 406, 420 of the Indian Penal Code.

As per the prosecution case, petitioner collected advance from retailers and did not deposit the same in the account of informant's Company and thereby misappropriated an amount of Rs. 11,44,637/-.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Entire allegation is false and concocted. As per the agreement between the parties, petitioner is accountable for transportation of milk and milk products and transporter-cum-distributor is required to make online payment in advance and on satisfaction of payment

No.43485 of 2021(3) dt.03-01-2022 2/2 the milk and milk products are delivered to the petitioner for the purpose of supplying the same to the retailers on their demand and in such circumstance, there is no question of collection and misappropriation of money from the retailers. Petitioner is in custody since 13.02.2021 having clean antecedent. Chargesheet has already been submitted.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda in connection with Deepnagar P.S. Case No. 301 of 2020.
