JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2019 This is an application for grant of anticipatory bail in connection with Jai Nagar P.S. Case No. 531 of 2018, disclosing offences under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition Excise Act, 2016. Allegation is of recovery of 46 bottles foreign liquor each containing 180 ml and 46 bottles Nepali liquor each containing 300 ml from a middle school and one accused person was arrested and he disclosed the name of the petitioners. Submission of learned counsel for the petitioners is that the petitioners have falsely been implicated in this case and nothing has been recovered from their possession or from their house. Further, they have no criminal antecedents. Heard learned A.P.P. also.

Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II cum Special Judge Excise Act, Madhubani, in connection with Jai Nagar P.S. Case No. 531 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
