The petitioners, namely, (1) Prakash Giri (2) Raj Kumar Giri, who are in custody in connection with Rivilganj P.S. Case No.46 of 2014 for offence punishable under Section 341, 323, 324, 307, 504, 379 of the I.P.C.
According to the prosecution case, the petitioners along with the co-accused persons assaulted with intention to kill the informant party by knife. The learned counsel for the petitioner submitted that the injury found on the persons of the informant party are caused heart and blood substance. Patna High Court Cr.Misc. No.48518 of 2014 (2) dt.20-02-2015 2 / 2 submitted that the petitioner No.(1) is in custody since 2.9.2014 and the petitioner No.2 is in custody since 3.9.2014. In view of the fact that the allegation is assault by a knife whereas the Doctor found the injury caused by heart and blood substance, I direct that the above named both the petitioners be released on bail on furnishing bail bond of Rs.5,000/- (five thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Rivilganj P.S.
