JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2019 This application, for grant of anticipatory bail, arises out of Excise Case No. 397 of 2018, disclosing offences under Sections 30(a) of the Bihar Prohibition and Excise Act. Allegation is of recovery of 45.750 litres of liquor from the sugarcane field situated behind the house of the petitioner.

Submission of learned counsel for the petitioners that he has no criminal antecedent and has falsely been implicated in this case, which will appear from the fact that nothing has been recovered either from the house or from the conscious possession of the petitioner rather the recovery has been made from an open field.

Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge cum Special Judge, Excise, Motihari, East Champaran, in connection with Excise Case No. 397 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
