Petitioner seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code. Some unknown criminals looted away the Hywa truck of the informant and the F.I.R. was lodged against unknown. Subsequently, some different Hywa truck was recovered from the possession of eight persons including the petitioner and for that Ariyari Police Station Case No. 173 of 2014 was registered. In that case, petitioner has already been allowed bail. However, on the confessional statement, the petitioner was remanded in this case also.

Submission is that there is no TI Parade nor anything was recovered from the possession of the petitioner in

Patna High Court Cr.Misc. No.42292 of 2016 (3) dt.13-12-2016 the present case and co-accused Umesh Kumar Singh, on similar footing, has already been allowed bail in Cr. Misc. No. 51350 of 2016 on 05.12.2016.

Considering the aforesaid facts, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka/Successor Court in connection with Dhoraiya P.S. Case No. 230 of 2014.
