The petitioner seeks bail in Akbarpur P.S. Case No. 116/13, registered for the offences punishable under Sections 302 and other Sections of the Indian Penal Code.

Petitioner is not named in the FIR. Name of the petitioner figured in the confessional statement of co-accused. The police recorded the statement of witnesses after more than a month from the date of occurrence and the witnesses are said to have

Patna High Court Cr.Misc. No.10452 of 2015 (2) dt.17-03-2015 2/2 disclosed the name of the petitioner. It is further submitted that on same and similar allegation co-accused Harkhu Yadav, Raj Kumar Yadav, Pawan Yadav @ Pawan Kumar and Shanti Yadav have already been granted bail by this Court.

Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Nawada in Akbarpur in connection with Akbarpur P.S. Case No. 116/13.
