JUSTICE RAJIV ROY ORAL ORDER 09-09-2022 Heard learned counsel for the petitioner and learned APP for the State in Virtual Court Proceeding. Let the defect(s), if any, as pointed out by the office, be removed within four weeks.
The case is registered under Sections 323, 324, 307, 302/34 of the Indian Penal Code, in connection with S.T. Case No. 516/2013 arising out of Khaira PS. Case No. 112 of 2001.
The prosecution story in brief, is that the informant's mother was killed by Nepali Singh and three others by iron rod as the informant and her mother and step mother wanted to go outside for earning money.
Earlier the petitioner was granted privilege of bail
Patna High Court CR. MISC. No.33904 of 2022(2) dt.09-09-2022 2/3 vide Cr. Misc. No. 46762 of 2018 on 29.08.2018. However, as he failed to appear before the trial court, accordingly his bail bond was cancelled on 31.3.2022. Upon knowledge, he promptly came into judicial custody on 8.4.2022. Considering the conduct of the petitioner of having surrendered within a week of cancellation of bail, this Court is inclined to grant him the privilege of bail.
Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge-Vth, Jamui, in connection with S.T. Case No. 516/2013 arising out of Khaira PS. Case No. 112 of 2001 subject to the following conditions:
(i) one of the bailors should be the family members of the petitioner, who shall provide official document to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for every date without plausible reasons will entail his cancellation of bail by the Trial Court itself;
(iii) he shall appear before the concerned police station every month till conclusion of the trial to mark his

With the aforesaid observations, the bail application is allowed.
