JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-11-2019 The petitioner is stated to be serving as an Army Officer in the Indian Armed Forces and seeks transfer of arm licence of his martyred brother, who was also serving in the Indian Armed forces, in his name, as per the provisions contained in Rule 25(1)(a) of the Arms Rules, 2016. It is submitted on behalf of the petitioner that the appropriate application has been submitted before the District Magistrate, Patna on 24.11.2015 itself, however, no action is being taken.

Patna High Court CWJC No.4610 of 2017(7) dt.07-11-2019 2/2 This Court is of the view that the State Government should be sensitive to the needs and grievances of the serving army personnel and immediate action is required to be taken in their cases.

In such view of the matter, the District Magistrate, Patna is directed to consider the aforesaid application of the petitioner dated 24.11.2015 and pass appropriate orders within a period of eight weeks from the date of receipt/ production of a copy of this order, in accordance with the provisions contained in Arms Rules, 2016, as aforesaid.

The writ petition stands disposed of on the aforesaid terms.
