The petitioner is languishing in custody since 22.01.2015 in a case registered for the offences punishable under Sections 410, 411, 413, 114 of the Indian Penal Code and 137 of the Indian Electricity Act.
One Bolero vehicle was intercepted from which four persons were apprehended including the petitioner. Bolero vehicle was carrying stolen aluminium electric wire.
It is submitted by learned counsel for the petitioner that vehicle in question is registered in the name of the petitioner and it was hired by some one else. The petitioner was not travelling in the vehicle. Subsequent to interception, the petitioner was called by police station to bring the papers of the vehicle and thereafter the petitioner was roped
Patna High Court Cr.Misc. No.10721 of 2015 (2) dt.23-03-2015 2 / 2 in the present case.
Considering the nature of accusation and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Nawada, in connection with Narhat P.S. Case No. 13 of 2015.
Since the petitioner is an accused in one other case apart from the present one, let the learned court below cancel the bail bond of the petitioner if he defaults for two consecutive occasions or substantially gets involved in some serious nature of offence.
