2. The petitioner seeks bail in a case registered for the offence punishable under Sections 191 (2), 191 (3), 190, 109, 103 (1), 331 (4), 305, 76 and 61 (2) of the B.N.S. and Section 27 of the Arms Act.
3. The prosecution case as disclosed in the first information report is that 10 accused persons including the petitioner and 25 to 30 unknown came variously armed to the house of the informant and one Sanjay Yadav fired with double barrel gun on the mother of the informant, which hit her on right arm. Co-accused, Bhupendra Yadav alias Bhaiya Lal Yadav fired on Parmanand Yadav, who died on spot. The allegation on the rest of the persons is that they entered into the house and

It is submitted by learned counsel for the petitioner that from perusal of the first information report it would appear that the specific allegation of firing upon the deceased, Parmanand Yadav is on Ajay Yadav and Vijay Yadav on the order of Bhupendra Yadav. There is also allegation of firing on Sanjay Yadav which hit the mother of the informant. So far as the petitioner is concerned, although he is named in the F.I.R. but no specific allegation has been attributed to him. The petitioner has been languishing in custody since 05.03.2025.

Taking into consideration the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Bhargama P.S. Case No.246 of 2024.
