====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-05-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Nawada Town P.S. Case No. 219 of 2018, registered under Sections 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioners submits that it would appear from the F.I.R. that informant is not the eye witness of the murder of his son Chandan Kumar rather informant has raised suspicion about having hand of Arpit Yadav and Rabindra Yadav in the murder of his son due to

But in course of investigation, police recorded the statement of witness, Umesh Prasad, who only disclosed that deceased along with Ranjit Kumar, Pintu Yadav (petitioner no.1), Bindeshwar Yadav (petitioner no.2) and Pintu Singh run the business of illicit liquor and there was dispute in between them for distributing the money. Later on, Ranjit Kumar was apprehended, who confessed his guilt disclosing the name of petitioners in the present case, except that nothing has been collected against the petitioner. Further submission is that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Nawada Town P.S. Case No. 219 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
