JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-01-2019 The petitioners seek bail in anticipation of their arrest in connection with Bihta P.S. Case No. 264 of 2018 dated 15.03.2018, corresponding to Special Case No. 2421 of 2018 instituted for the offences under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.
Approximately 1000 litres of locally brewed liquor is said to have been recovered from a place from where three persons were arrested. The aforesaid three persons have named another fifteen persons who were supposedly involved in the manufacturing/brewing of country-made liquor. The petitioners have been named by the aforesaid accused persons.
Patna High Court Cr.Misc. No.79272 of 2018(2) dt.25-01-2019 2/2 Mr. Pramod Kumar, learned counsel for the petitioners has submitted that similarly situated accused persons who were also named by the arrested accused persons in their confessional statements, have been granted anticipatory bail by a Bench of this Court by order dated 23.07.2018 passed in Cr. Misc. No. 44400 of 2018. Regard being had to the aforesaid facts as also taking into account the clean antecedents, the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Bihta P.S. Case No. 264 of 2018, corresponding to Special Case No. 2421 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
