The petitioner is languishing in custody since 20.09.2014 in a case registered for the offences punishable under sections 399/402/414/34 of the Indian Penal Code and section 3⁄4 of the Explosive Substances Act.
On information that the some miscreants are preparing to commit dacoity a raid was led when three persons escaped from the scene but the petitioner along with co-accused Raju Dubey and Nitesh Singh were arrested. From the possession of the petitioner one loaded country made pistol with three live cartridges, mobile and Rs.2,000/- were recovered while from the co-accused Nitesh Singh material for preparing explosives were
Patna High Court Cr.Misc. No.14178 of 2015 (4) dt.06-07-2015 2/2 recovered. Apart from the present case, for recovery of arms from the petitioner separate case was lodged being Bhagwanpur P.S. Case No.226 of 2014, in which, as submitted, the petitioner has been granted bail vide Criminal Miscellaneous No. 13307 of 2015 and the investigation has already concluded. Considering the nature of accusation, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Bhagwanpur P.S. Case No.225 of 2014.
Since the petitioner has serious criminal antecedent, learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions or gets involved in some serious nature of offence.
