Perused the impugned order dated 24.08.2016 passed by Civil Judge, Dehri-on-sone, Rohtas in Execution Case No.3 of 2013 whereby the learned Executing Court has only passed the order to the effect that judgment debtor had filed an application for stay. Copy of the application was given to the plaintiff. The case was then next fixed for further steps regarding delivery of possession.

In my opinion, this is only a routine order. The application filed by the petitioner has not yet been disposed of. In other words, no order has been passed till today. Therefore, the petitioner may press his application before the Executing Court. With this direction, this Civil Miscellaneous application is disposed of.
