2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 414 of the Indian Penal Code.

3. The case of the prosecution in short is that while the informant was on night patrolling duty with the police party on 25.08.2019, he received secret information that the petitioner has kept stolen Apache bike at his house and he used to sell the stolen bike. On verification of the petitioner, the police recovered one TVS Apache bike bearing registration No. BR01DB3019 parked in the boundary of the petitioner.

4. Learned counsel for the petitioner submits that the recovery has not been made from the house of the petitioner

Patna High Court CR. MISC. No.32670 of 2025(2) dt.22-05-2025 2/2 rather recovery has been made from the boundary which is open. Learned counsel for the petitioner has also filed supplementary affidavit showing that the witnesses of seizure list have given affidavit before the learned trial court that their signatures were taken on a plain paper. The petitioner is in custody since 18.04.2025. Learned counsel further submitted that sentence for the alleged offence is only three years.

5. Learned APP appearing for the state has opposed the prayer of regular bail. He submits that the petitioner is having criminal antecedent of four cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kadirganj P.S. Case No. 94 of 2019 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Masaurhi.
