The petitioner seeks bail in connection with Falka P.S. Case No. 121/2014 for the offence punishable under section 364 of the Indian Penal Code.

The prosecution case , in brief, is that the husband of the informant is missing since 14-12-2010, and a suspicion has been raised against the petitioner and his family members to have been killed by them.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 13-3-2015. Further, it has been submitted that due to land dispute the present case has been instituted against the petitioner.

It has been further brought to the notice of this Court that the other similarly situated co-accused Bideshi Thakur, Hari

Patna High Court Cr.Misc. No.16926 of 2015 (2) dt.11-06-2015 2 / 2 Thakur and Manju Devi have been granted bail by this Court-vide order dated 30-4-2015 in Cr.Misc. No. 48426 of 2014. Considering the facts and circumstances of the case, let the petitioner Hari Thakur be released on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Katihar, in connection with Falka P.S.
