The petitioner seeks pre- arrest bail in Marhowrah P.S.Case No.332/18 registered under Section 30(a) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 5 litres spirit from the motor cycle of the co-accused and it further appears that the petitioner is an accused in one more case.

Submission on behalf of the learned counsel for the petitioner is that later on he has been made accused in another case also which is after the lodging of the present case. Heard the learned Additional P.P. also.

Having heard both sides and in view of the facts and circumstances of the case, I am not inclined to grant anticipatory bail to this petitioner. Prayer for anticipatory bail is rejected.

No.78919 of 2018(2) dt.11-01-2019 2/2 However, if the petitioner surrenders before the court below and pray for regular bail, the learned court below shall consider the same and dispose of on its own merit and, if possible, on the same day without being prejudiced by this order.
