JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 1845 of 2014, corresponding to Trial No. 1715 of 2018, in which cognizance has been taken under Section 498A IPC and Sections 3/4 of Dowry Prohibition Act. Allegation as per complaint petition against the petitioner, who happens to be husband of the complainant, is that he subjected his wife complainant to torture with respect to demand of dowry. Submission of learned counsel for the petitioner is that whole allegation is false and concocted and he is still ready to keep the complainant with him with dignity and care. On the other hand, learned counsel for the complainant has submitted that she is also

In view of above facts and circumstances, let petitioner surrender on 19.8.2019 before the court below, on that day opposite party No.2 shall remain present in court. Further on filing of an affidavit by the petitioner that he is ready to keep the complainant with him with dignity and care and also ready to take her from the court itself to his house, he shall be released on provisional bail for a period of six months to the satisfaction of the court concerned and during that period the court will watch their conduct and marital relationship by calling then in every third week of every month and once the court is satisfied with their marital relationship and conduct, specially the petitioner, his bail bonds shall be confirmed, otherwise the court is free to pass any other order(s) as it may deem fit and proper, including cancellation of bail bonds of the petitioner. With the above observation, this application is disposed of.
