The petitioner seeks bail in anticipation of his arrest in connection with Nayagaon P.S. Case No. 06 of 2020 instituted for the offences under Sections 341, 323, 353 and 504 of the Indian Penal Code and Section 135 of the Electricity Act.

The cycle shop of the petitioner was raided and it was found that electric energy was being extracted unauthorizedly.

Patna High Court CR. MISC. No.32418 of 2020(2) dt.09-02-2021 2/3 Learned counsel for the petitioner has submitted that in the F.I.R. itself, it has been alleged that the petitioner used to pay Rs. One Thousand to his landlord/Navin Kumar towards electricity expenses. If there was no proper connection, Navin Kumar / the landlord of the shop was responsible for the same and not the petitioner. The petitioner, admittedly, is a tenant of aforesaid Navin Kumar, which would appear from the rent agreement, which has been executed on 15.01.2020 for the purposes of running the cycle shop.

The consumption of the electrical energy for the shop of the petitioner is very meager.

Considering the afore-stated facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Begusarai, in connection with
