2. At the very outset, learned counsel for the petitioners has submitted that prayer for anticipatory bail application with respect to petitioner no. 3 has already been ordered to be dismissed as withdrawn vide order dated 22.05.2025.

3. The petitioner no. 1 and 2 apprehend their arrest in connection with Mansi P.S. Case No. 292 of 2024, registered for the offences punishable under Sections 115(2), 126(2), 117(2), 109, 303(2), 351(2), 352, 3(5) of the BNS and 27 of the Arms Act.

4. As per allegation, petitioner no. 1 fired two rounds shot on the Barun Yadav who become injured. Thereafter, petitioner no. 2 along with other accused person assaulted him with iron rod.

5. The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. There is case and counter case between the parties and the members of the petitioners' side have also suffered injuries.

6. Learned APP for the State opposed the prayer for anticipatory bail of the petitioners.

Considering the above-mentioned facts and circumstances, let the petitioner no. 2, namely, Angad Yadav, in the event of his arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria in connection with Mansi P.S. Case No. 292 of 2024 subject to the conditions as laid down under Section 438(2) Cr.P.C./ 482(2) of the BNSS, 2023.

8. So far as petitioner no. 1 is concerned, there is allegation against him of assaulting one, Barun Yadav by firing

Patna High Court CR. MISC. No.34614 of 2025(5) dt.04-11-2025 3/3 two round shots as a result of which he suffered two gun shot injuries which is corroborated by the injury report. Accordingly, the anticipatory bail application with respect to petitioner no. 1 stands rejected.

9. The petitioner no. 1 is directed to surrender in the Court below and seek regular bail. If he does so, his regular bail application shall be considered on its own merit without being prejudice by this order.
