Although the petitioner is named in the first information report but according to prosecution case itself, he was standing in the lane at the time of alleged occurrence and when the co-accused after committing the murder of deceased, came out of the house, the petitioner along with others fled away from there. Paragraph-3 of the petition reveals that the petitioner does not have any criminal antecedent. Moreover, investigation of the case has already been completed. Considering the aforesaid facts and circumstances

Patna High Court Cr.Misc. No.5912 of 2015 (2) dt.12-02-2015 2/2 as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Hathidah P.S. Case No. 71 of 2014 to the satisfaction of Sri R. K. Verma, Judicial Magistrate-Ist Class, Barh, Patna.
