JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-02-2019 This is an application for grant of anticipatory bail in connection with Biharsharif P.S. Case No. 305 of 2018, disclosing offences under Sections 147, 148, 149, 323, 326, 307 and 504 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation as per F.I.R. is of firing by one co-accused person and the petitioner was also present there. Submission of learned counsel for the petitioner that he along with several other accused persons have been made accused in this case and no specific allegation has been attributed against him and allegation of firing is against other accused person. Further, he has no criminal antecedent. Heard learned A.P.P. also.
Having heard both sides, considering the above
Patna High Court Cr.Misc. No.79078 of 2018(3) dt.08-02-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Biharsharif P.S. Case No. 305 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
