====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 03-03-2021 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 353, 307/34 of the Indian Penal Code and Sections 25(1-AA), 25(1-A), 25(1-B)a, 26, 27, 35 of the Arms Act. Earlier prayer for bail of the petitioner was rejected vide Annexure-1 to the present application taking into account that the petitioner and other accused persons fired upon the police party and furthermore, the recovery of one rifle and six live cartridges were made from possession of the petitioner. A report was called for from the trial court. It has been reported that charge has not been framed till date. On behalf of the petitioner, it is submitted that the

Patna High Court CR. MISC. No.33717 of 2020(3) dt.03-03-2021 2/2 petitioner is in custody since 15-05-2018. He has already remained in custody for approximately two months short of three years. There is no chance of the trial being concluded in near future. There is no compliance of Section 100 of Cr.P.C. while making the seizure of the arms. The other co-accused with similar allegation has been granted bail by a coordinate bench of this court vide order dated 29-11-2018 passed in Cr. Misc. No. 69744 of 2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-IV, Begusarai in connection with Sessions Trial No. 91 of 2020 arising out of Balia P.S. Case No. 117 of 2018.
