2. The petitioner seeks regular bail in connection with Pipra P.S. Case No. 329 of 2023, lodged under Sections 363, 365 and later added Sections 302, 201 and 120(B) of the I.P.C.

3. As per the prosecution case, the F.I.R. has been lodged against unknown accused persons but subsequently, in confessional statement of co-accused, it has come that it is the co-accused, who had killed the deceased and the petitioner was directed to keep a watch at the time of occurrence.

4. Learned counsels for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is in custody since 05.11.2023 having clean antecedent. The name of the petitioner has figured in this case

Patna High Court CR. MISC. No. 37150 of 2024(3) dt.18-09-2024 2/2 by virtue of confessional statement of co-accused, namely, Prakash Kumar @ Shivam Kumar.

5. Learned A.P.P. for the State opposes the prayer for bail.

6. Learned counsel for the informant vehemently opposes the prayer for bail and submits that since the petitioner was keeping a watch at the time of murder, though he may not be released on bail.

7. Considering the facts and circumstances of the case and the period of custody, this bail application is allowed.

8. Let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Successor Court, Supaul in connection with Pipra P.S. Case No. 329 of 2023, subject to the condition that the petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court through himself or through his lawyer.
