There is specific allegation against the petitioner that he committed rape upon a 14 years old handicapped girl. Learned counsel, appearing for the petitioner submits that the victim was examined by the Medical Board but no external or internal injury was found and the Medical Board report completely falsifies the prosecution story. It is further contended by him that the informant lodged this case on account of previous enmity.

Considering the facts and circumstances of the case as well as submission of the parties, particularly keeping in mind the nature of allegation levelled against the petitioner, I am not

Case No. 364 of 2014 pending in the court of Additional Sessions Judge-Ist-cum-Special Judge, Posco) Act, Begusarai stands rejected at least, at this stage.
